Right of Withdrawal for Consumers

(A consumer is any natural person who concludes a legal transaction for purposes that can be attributed neither to their commercial nor their independent professional activity.)

Cancellation Policy

§ 1 Statutory Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day,

• on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
• on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
• on which you or a third party designated by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered a good that is delivered in several partial shipments or pieces;

To exercise your right of withdrawal, you must inform us (M&M Vertriebs GmbH & Co.KG, Goldbinnen 1, 31840 Hessisch Oldendorf, Phone number: +495152-698860, Fax number: +495152-6988610, Email address: info@drum-tec.de) by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, which you can find at the end of this policy, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we must reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired. We will bear the costs of returning the goods for shipments within Germany during the first fourteen days. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Reasons for Exclusion or Expiry

The right of withdrawal does not apply to contracts

• for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;
• for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded;
• for the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can only be delivered 30 days after the conclusion of the contract at the earliest and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
• for the supply of newspapers, periodicals or magazines with the exception of subscription contracts.
• for the supply of goods that are wear parts (e.g. sticks, mesh heads, drum heads, cables, beaters, ...).

The right of withdrawal expires prematurely for contracts

• for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
• for the supply of goods if these have been inseparably mixed with other goods after delivery due to their nature;
• for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.

§ 2 drum-tec 30-day Money-Back Guarantee (Extended Right of Return)

1. In addition to the statutory 14-day right of withdrawal, drum-tec offers consumers a money-back guarantee for the subsequent 16 days. Consumers can return goods received from us without giving reasons within 30 days by returning the goods. The period begins on the day,
   • on which you or a third party designated by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
   • on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
   • on which you or a third party designated by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, provided that you have ordered a good that is delivered in several partial shipments or pieces;
2. To meet the deadline, timely dispatch of the goods or the request for return is sufficient. The right of return can only be exercised by returning the goods. The 30-day money-back guarantee only applies to distance selling contracts according to § 312c BGB. drum-tec bears the costs of returns within Germany within the first fourteen days as part of the right of withdrawal. All further return costs are borne by the customer.
3. The right of return exists for the order of shrink-wrapped or sealed data carriers such as CDs, audio cassettes, videos, DVDs, but also newspapers and magazines as well as software only if the corresponding goods are returned to us in the shrink wrap or with an undamaged seal.
4. The right of return is completely excluded insofar as goods are manufactured according to customer specifications, are custom-cut goods, wear parts (e.g. mesh heads, rim noise eliminators, sticks, drumheads, cables, beaters, cleaning agents, ...) or articles that cannot be returned for hygienic reasons (e.g. towels).
5. If the consumer makes use of their right of return, drum-tec is entitled to demand a reasonable fee for the period the goods remained with the customer.
6. Furthermore, the customer who makes use of their right of return must compensate drum-tec for the reduction in value or the value of the goods, insofar as the customer cannot properly return the goods because they are responsible for the deterioration, destruction or other impossibility. This does not apply if the deterioration of the goods is exclusively due to their inspection – as would have been possible for the customer in a retail store. Otherwise, the customer can avoid the obligation to pay compensation for value by not using the goods as their property and refraining from anything that impairs their value.
7. If individual components of a bundle or set are returned within the 14-day withdrawal period or the drum-tec 30-day money-back guarantee, the remaining items with the customer will be re-invoiced at the regular individual retail price.
